Expungement of Florida Criminal Records


One of the worst things about a criminal record is that it can prevent an individual from getting the job he or she wants since many employers now perform a criminal background check before hiring. Some employers will refuse to hire someone even if that person received a withhold of adjudication or were merely arrested and had charges dropped.

In Florida, the criteria to be eligible for expungement or sealing:

1. You were never adjudicated guilty of a criminal offense. You’re still eligible if you may have had your adjudication withheld.

2. You never secured a prior sealing or expunction of a criminal history record under Florida statutes or from any jurisdiction outside the state.

3. Your offense doesn’t include sexual crimes or “dangerous crimes” including sexual battery, lewd, lascivious, or indecent assault or act upon or in the presence of a child, sexual performance by a child, trafficking in controlled substances and/or conspiracy to engage in trafficking in controlled substances, or various crimes like arson, aggravated assault, aggravated battery, kidnapping, manslaughter, robbery, homicide, hijacking, or burglary of a dwelling.

Remember, this is just a short list of the crimes in which expungement is not possible. You may however, get the arrest expunged for offenses from this list if the case was dropped or abandoned.



The procedure includes:

1. Applying to the Florida Department of Law Enforcement (FDLE) for a certificate of eligibility for sealing or expunction. The application for the certificate of eligibility must include: A money order, cashier’s check, or certified check for $75.00 made payable to: FDLE.

2. Filing with the court your petition for sealing or expunction, along with the Certificate of Eligibility. The whole process should take about three to four months, although it can take longer in some cases.
